1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Visapot ("Company," "we," "us," or "our") governing your access to and use of the Visapot mobile application and all associated services (collectively, the "Services").

2. Eligibility

You must be at least 16 years of age to create an account and use the Services. By using the Services, you represent and warrant that:

• You are at least 16 years old;
• You have the legal capacity to enter into this agreement;
• You are not prohibited from using the Services under the laws of your country of residence; and
• All information you provide is accurate, current, and complete.

3. Account Registration

3.1 Account Creation

You may register for an account using a valid email address and password, or via supported third-party OAuth providers (e.g., Google, Apple). You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibility

You are solely responsible for:

• All activity that occurs under your account;
• Keeping your password secure and not sharing it with any third party;
• Notifying us immediately of any unauthorised use of your account at info@visapot.com.

3.3 Account Accuracy

You agree to provide accurate and truthful information during registration and to keep your profile information up to date.

3.4 One Account Per User

Each user may maintain only one active account. Creating duplicate or fraudulent accounts is strictly prohibited.

5. User-Generated Content

5.1 Licence Grant

When you submit visa application data or any other content to the Services ("User Content"), you grant Visapot a worldwide, royalty-free, non-exclusive, sublicensable licence to use, store, reproduce, aggregate, anonymise, and display such content for the purpose of operating and improving the Services.

5.2 Accuracy and Responsibility

You represent that all submitted information is accurate, complete, and based on your genuine personal experience. You must not submit false, misleading, fabricated, or speculative application data.

5.3 Prohibited Content

You may not submit content that is false, misleading, fraudulent, defamatory, harassing, contains personal data of third parties without their consent, or violates any applicable law or regulation.

5.4 Anonymous Submissions

You may choose to submit application entries anonymously. Anonymised submissions will still be used to generate community statistics but will not be publicly associated with your profile.

6. Acceptable Use Policy

You agree to use the Services only for lawful purposes. You must not:

• Use the Services for any unlawful purpose or in violation of any laws or regulations;
• Attempt to gain unauthorised access to any part of the Services;
• Use any automated means (bots, scrapers, crawlers) to access or collect data from the Services;
• Interfere with or disrupt the integrity, performance, or security of the Services;
• Reverse engineer, decompile, or disassemble the App;
• Impersonate any person or entity;
• Upload or transmit viruses, malware, or other malicious code;
• Use the Services to spam, solicit, or engage in unsolicited commercial communication;
• Circumvent or attempt to circumvent any security or access controls.

7. Intellectual Property

7.1 Our Property

All rights, title, and interest in and to the Services, including but not limited to the App, software, design, text, graphics, logos, datasets, and all associated intellectual property rights, are and remain the exclusive property of Visapot and its licensors.

7.2 Limited Licence to Users

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial purposes, subject to these Terms.

7.3 Restrictions

You may not copy, reproduce, distribute, publicly display, create derivative works of, or otherwise exploit any part of the Services without our prior written consent.

8. Third-Party Services

The Services integrate with the following third-party platforms:

• Supabase – Backend infrastructure and authentication
• Firebase (Google) – Analytics, crash reporting, and push notifications
• Google / Apple – OAuth sign-in providers

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the acts or omissions of any third-party service provider.

9. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.

To the fullest extent permitted by applicable law, Visapot disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and that the Services will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Visapot, its directors, employees, partners, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or goodwill; or any damages arising from your reliance on community data or any information available through the Services.

Our total aggregate liability to you for any claim shall not exceed the greater of (a) USD $50 or (b) the total amount you have paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Visapot and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Services, your violation of these Terms, or any User Content you submit that is false, misleading, or unlawful.

12. Termination

12.1 By You

You may terminate your account at any time by contacting us at info@visapot.com.

12.2 By Us

We reserve the right to suspend or terminate your account at any time, with or without notice, including for violation of these Terms, provision of false information, or conduct harmful to other users or the integrity of the Services.

12.3 Effect of Termination

Upon termination, your right to access and use the Services ceases immediately. Sections 7, 9, 10, 11, and 14 shall survive termination.

13. Changes to the Services and Terms

We reserve the right to modify, suspend, or discontinue any part of the Services at any time. When we make material changes to these Terms, we will notify you via in-app notification or email at least 14 days before the new Terms take effect. Your continued use after the effective date constitutes acceptance.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from or relating to these Terms shall be resolved as follows:

1. Informal Resolution: Contact us first at info@visapot.com to attempt to resolve any dispute informally within 30 days.
2. Binding Arbitration: If informal resolution fails, disputes shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration body.
3. Class Action Waiver: To the extent permitted by law, you agree to waive any right to bring claims as a class or representative action.

15. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Visapot.
• Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full force.
• Waiver: Our failure to enforce any provision shall not be deemed a waiver.
• Assignment: You may not assign rights under these Terms without our prior written consent.
